Abstract

CASAGRANDE, Agustín E. Literatura Práctica en el siglo XVIII: El orden  procesal en la historia de la justicia Rioplatense. Rev. hist. derecho [online]. 2015, n.49, pp.1-32. ISSN 1853-1784.

The present essay tend to analyze the emergency and the functions of a particular juridical literature  -Prácticas-, which circulated during the XVII and XVIII centuries in the Hispanic American territories, through the light shed by the political context that determined its production. Besides, this literature would serve as an example to comprehend the roots of a slow passage from the judicial exercise, which had been seen as a political action and began to be presented as a mere practical and procedural act. Finally, through this analysis some methodological problems are revisited, trying to show the importance of working with the "Prácticas" to better comprehend the judicial sources from the archives.
