Abstract

This work aims to recreate and ponder the weight that previous forensic experiences of the deputies to the Congress of Tucumán (1816-1820) had in their legislative and constituent action, as a dense intellectual and experiential background. With this aim in mind, the question arises as to how the administration of justice was treated in the debates arising from the discussions on the Provisional Statute of 1816, the 1817 Regulations, and the Constitution of 1819; In the role of the congress by evacuating judicial consultations; And in the presence of ambiguities in the attitude of the Assembly towards the administration of justice. It is concluded that it is possible to ascribe the judicial conceptions of the Congress to a conservative line of argument.
