Abstract
PANATERI, Daniel Alberto. Uso, costumbre y fuero en relación al discurso medieval de la soberanía: Alfonso X el Sabio y la glosa de Gregorio López. Temas mediev. [online]. 2012, vol.20, n.1, pp.00-00. ISSN 0327-5094.
Legal discourse is one of the key elements for the analysis of political development. The Late Middle Ages are the central period in which this discourse developed, and therefore its study entails the possibility of achieving fundamental findings about the relationship between the ideological construction of the State and its material reality. Within this context the Castilian case is paradigmatic. The legislative work of Alfonso X and its main product, Siete Partidas, represent a legal and political milestone for the thirteenth century. The analysis of this work, along with its sixteenth- century apparatus of glosses, provides a constant and seemingly inexhaustible source of elements that enable us to track central legal concepts of the political discourse that began in the thirteenth century. Therefore, our proposal is to analyze the often dynamic concept of legislative sovereignty in Alfonso's legislative work as well as the alterations it suffered in the glosses, in order to try to reach a historical conception of the concept in its period of construction.
