Abstract

MAUREIRA, Max. Intrascendencia del derecho.: Fichte ad Kant. Tópicos [online]. 2011, n.22. ISSN 1666-485X.

That the right be deduced of the morality, understood she in wide sense, is evident in Kant, but not in Fichte. In effect, according to the latter the right is, rather, a condition of the deployment of the freedom. That one that is realized freely, and that, according to Fichte, in this measure constitutes the reality, is autodisposed. Therefore, this one requires for self the exigency of a concretion. It is, consequently, a moment of the same thing: the genesis of the own freedom. With the right does not be appealed here to any simpliciter transcendence. This work be dedicated to showing this genetic fichtean comprehension of the right.
