Difficulties in guaranteeing the supply of specific drugs for the treatment of human immunodeficiency virus / acquired immunodeficiency syndrome (HIV/AIDS) are recurrent given the advancement of adjustment policies. In Argentina, the gear that sustains compliance with public health obligations is permeable to crisis. The problem focuses on the most acute crisis in Argentina in December 2001, from Oszlak and O'Donnell´s perspective.

Objective: to reconstruct the processes of discussion, generation and implementation of public policies from the National Health Ministry -specifically in its interaction with international agencies- in order to guarantee the supply of antiretrovirals (ARV) to all people living with HIV/AIDS of the country. Qualitative approach, documents were used: four dossiers of the medication management of the National Health Ministry and minutes of Commissions. Semi-structured individual interviews were conducted with key actors according to their role during the health emergency. A category of the first dimension is presented: Strategies implemented by the State to guarantee the acquisition of ARV, category: international agencies. A data matrix was constructed to analyze the information. The reconstruction showed that the problem had an international agenda and that the commitments had to be fulfilled despite the crisis.

Tensions and contradictions are found within the framework of economic, social and cultural rights, taking into account the progressivity and non-regressivity of rights. States have double international pressure: agencies that monitor indicators rights and in the other side, lending agencies that define the priorities of recipient countries. Institutionally weak States, with low autonomy and in crisis generate programmatic vulnerability. Access to medicines is essential to achieve the right to health and it is a constant problem in emerging countries.
