Abstract

VENEZIA, Luciano. ¿Es "justicia como equidad" una concepción política de la justicia?. Rev. latinoam. filos. [online]. 2008, vol.34, n.2, pp.259-299. ISSN 1852-7353.

In the present article I argue that John Rawls does not succeed in developing "justice as fairness" as a political conception of justice. Rawls's adoption of T. M. Scanlon's principle of moral motivation is incompatible with the basic theses of his theory of political justification. Now, I understand that Rawls must ground "justice as fairness" with a principle such as Scanlon's both for conceptual reasons as well as for reasons internal to the theory of political justification. Therefore, I believe Rawls cannot weaken his commitment to this principle. This fact makes Rawls's theory untenable as it stands.
