Abstract

The purpose of the paper is to analyze the presence of the derecho indiano in the opinions in administrative matters issued by the Attorney General as advisor of the Executive, taking as source the "Dictámenes en lo administrativo de los Procuradores Generales de la Nación" (1862-1917), and not the opinions of these officials as attorneys before the Supreme Court in judicial cases -which are published in the collection "Fallos de la Corte Suprema de Justicia de la Nación"-. To that end, I begin with a reference to the background of the figure of the Attorney General and of the publication that I use as a source. I then move to the review of the derecho indiano cited in the reports of the five attorneys who served between 1862 and 1917, in order to detect the continuity of the citation of the derecho indiano in administrative matters, in the early years of the National Organization and even in the first decade of the twentieth century.
