Abstract

Mendoza's first constitution established the institutional and legal basis on which the provincial government was built. Its practical application, however, showed issues. One of these layed in the scope and definition of the immunity of representatives of the Chamber. Although this was defined in article 24 of the constitution, on each occasion that a deputy was indicted and / or arrested, raised debates on Legislature about the scope and limitations of that article as well as attempts to regulate it. The aim of the paper is to examine the issue of immunity from constitutional law and legislative practice. The hypothesis is that the deputies switched    -according to the circumstances- between a minimum and a broad interpretation of article 24. The documentary corpus is composed of minute books of legislative sessions and documentation send to and received from the executive and judicial powers.
