Abstract

The present paper approaches the study of the constitutional text that was approved in Jimaguayú, in 1895, in the middle of the Cuban Independence War, which took place between 1895 and 1898. The paper not only analyzes the structure and content of the mentioned constitutional text, but also pays attention to the main trends that were manifested in the debates of the Constituent Assembly in which it was redacted, as well as taking into account the main issues that were discussed in that Assembly. It also analyzes the importance that José Martí's thought could have had in the final configuration of the form of government adopted in the Jimaguayú Constitution, and outlines the immediate antecedents of the constitutional text in question.
