Abstract

The research aims to analyze the passage from the justice of peace to the learned justice at the beginning of the twentieth century, until its consecration in 1934, framed in a conflict in which “modernity” had to circumvent tradition and also routine and interests stuck in a difficult terrain to remove. Several questions were developed around the concept of Justice and its scope. The quid of the question was conceptual and practical: whether the administration of justice offered a double facet: scientific and popular, or should be entirely scientific. The background allows us to appreciate the interplay between the institutional function or the preventive function with respect to the so called social question and a fortiori the need to give it the best attention. In short, “learned” justice was imposed on the “peace” tradition and also on the routine and vested interests.
