Abstract

CASTANO, Sergio Raúl. The problem of the Indies in the crown of Castile.Exegesis of Juan de Solórzano pereira’s Política Indiana. Rev. hist. derecho [online]. 2018, n.56, pp.1-35. ISSN 1853-1784.

This article focuses on the study of the most significant work of the most relevant jurist of the Indias, Juan de Solórzano Pereira, in order to establish which would have been the position of the author concerning "the most important problem of the Indian Law" (Zorraquín Becú): i.e., the legal-political status of the Indies as a part of the Spanish monarchy. Namely, whether the Indies belonged to the kingdom of Castile itself or, as the movements of 1808-1810 proclaimed it in America, the Indies were only subject to the person of the Castilian monarch.

The issue is addressed in the context of Solórzano's doctrinal contemporary sources. The main conclusion is that Solórzano supported the former view. Nevertheless, this study ends up by analyzing a juridical institution that could have fuelled the thesis of a direct and personnel link between the Indies and the Castilian monarch.
