Our objective in this article is to investigate the ways in which the spread of venereal diseases as a public problem is linked to legal and criminal grammars, analyzing the specific process of configuring venereal contagion as a criminal figure, through Article 18 of Law 12,331 of 1936. We are interested in reflecting on how certain concerns linked to the transmission of diseases by sexual contagion came to be considered a legal-criminal problem around the 1920s and the outlines that were outlined to apprehend and conceptualize it. In this sense, we are committed to a methodological strategy that, rather than looking for technical or structural causes, addresses the discursive processes from which venereal transmission as a crime is constituted as such.
