Abstract
RATTI, Florencia. Argentinian federal courts of appeals: origin and historical evolution. Rev. hist. derecho [online]. 2020, n.60, pp.111-140. ISSN 1853-1784.
Federal Courts of Appeals did not exist neither in the Constitution nor in the first statutes regarding the organization of the National Judicial branch in Argentina. For almost five decades, federal judicial power was handled by single judges tribunals and the Supreme Court. This article explores why it was not until 1902 that courts of appeals were created and how they have evolved during the last century, until they reached their actual structure: collegiate courts with panels that solve cases simultaneously. Finally, this study delves with some challenges that collegiality and simultaneous panels involve in courts of appeals decision-making.
Keywords : federal courts of appeals; Argentine federal judicial power; history of judicial institutions, collegiate courts and panels.
