The construction of a regime of nationality with a certain and defined legal content was a process inherent to the emergence of nation-states that was not exempt from profound difficulties. If the Hispanic constitutionalism of the first decades of the nineteenth century was characterized by maintaining a pluralistic understanding of subjects, the central decades of the century would see projects of varying effectiveness to build a strong status of “national” against the “foreigner”. In this process, there were intellectual clashes and polemics with economic and social roots, sometimes accompanied by saber rattling.
To expose this thesis, we will observe the conceptions about the condition of the Argentine and the foreigner that fought in the tumultuous process of construction of the Argentine Republic from 1852 until the integration of the Province of Buenos Aires; particularly, regarding the problematic status of the children of the Spaniards in the Río de la Plata.
