This article focuses the parliamentary debate of the National Law of Education approved in Argentina from December of 2006 during the government of President Néstor Kirchner. A comparative historical frame is made of the approved '90 legislation, using as units of analysis the parliamentary debates which took place in the National Congress during the month of December of 2006. At the same time, the article analyzes the historical struggle between centralism and decentralization educative and the roll of the State in the construction of public policies.
