Abstract

This paper addresses the tensions and consensus that arose in defining the boundaries of the Argentine provinces during the second half of the nineteenth century. Based on the analysis of the parliamentary debates of 1862, 1878 and 1881 we maintain that the conceptions of the founding rights of the provinces and the positive possession were key elements in the discussions held by the legislators. Likewise, we restore the scope that both conceptions had in each of the moments analyzed and in the arguments raised in the National Congress to settle the disputes between the rights of the nation and the rights of the provinces.
