Abstract

ARROYO PICARD, Alberto  and  GHIOTTO, Luciana. Brazil and the new generation of Cooperation and Facilitation Investment Agreements: an analisys of the Treaty with Mexico. Relac. int. [online]. 2017, vol.26, n.52, pp.39-54. ISSN 2314-2766.

This article analyses the Agreement on Cooperation and Facilitation of Investments signed between Brazil and Mexico in 2015. We develop a comparison between this Agreement and the standard clauses of Bilateral Investment Treaties (BIT). It is stated that the ACFI belongs to the new generation of investment agreements. But even if these new agreements present some novelties, they still contain clauses that are similar to those that are present in BITs, such as National Treatment and Most Favoured Nation clauses; also, they present no obligations for investors and their investments.
