Abstract

VALAZZA, Renato Antonio. THE COMPLEXITY OF THE AWARD OFLIABILITYFOR DAMAGE THROUGH THE ENVIRONMENT. Rev. Fac. [online]. 2017, vol.8, n.1, pp.1-20. ISSN 1850-9371.

The paper proposes to analyze the normative criteria that, according to our civil law, must present the link that joins two facts and, whose verification, will allow to conclude that the first was the cause of the second. Describe the conceptual mutation of these legal guidelines, as well as the complexity of the verifying process. It stops at the study of expert evidence and the difficulties of its assessment, as they refer to the generic or specific causal link. Finally, some proposals are highlighted to provide greater predictability in the adjudication decision.
