Abstract

LOPEZ, Julio Mariano. SOME THOUGHTS ON THEFOUNDATIONS OFALTERNATIVE AND COLLECTIVE LIABILITY. Rev. Fac. [online]. 2017, vol.8, n.1, pp.1-20. ISSN 1850-9371.

Collective and alternative liability is a special kind of liability where the injurer not necessarily compensates the victim of a wrong. Instead, the liability can be awarded to any individual of the group that creates the risk. In order to explain this character, it may be useful to interpret the law of torts as a complex practice that is grounded in both principles of distributive as well as corrective justice.

Keywords : Collective liability - Alternative liability - Distributive justice -  Corrective justice..
