Abstract

The article makes a critical analysis of the legal framework of water sources and reserves in the Andes.Based on the reform of the Civil and Commercial Code (2015), it specifies the ownership of the water resource in the different stages of its cycle, including atmospheric humidity, snow and rain precipitation, snow and glacial accumulation, snowmelt, surface runoff, water accumulation in lakes and ponds, soil moisture, percolation and aquifers, springs that run off or become bogged down, and the reservoirs and water derivations. To conclude, it are synthesizes the advances and setbacks of a reform, that was not enough to set aside obsolete principles or overcome all pre-existing inconsistencies.
