In this paper, an analysis of the legal framework applicable to the cultural heritage of the Municipality of Benito Juárez, province of Buenos Aires, Argentina is addressed. It is identified what type of assets have been the subject of declarations and, therefore, formally protected at the national, provincial and municipal levels, with the aim of analyzing their scope and implications in the current local context. Based on a qualitative methodology, based on the documentary analysis of legal sources and the completion of complementary interviews, a SWOT analysis matrix (Strengths, Weaknesses, Opportunities and Threats) was developed. This strategy made it possible to identify and analyze the particular characteristics of the legal situation of cultural heritage in the area, from which it is proposed and suggested, on the one hand, to update the current norms to overcome a traditional vision of heritage and include participatory mechanisms for respond to community concerns. On the other hand, develop a future agenda that incorporates, among its central aspects, the creation of heritage inventories that will be useful to implement, among other things, the Land Management Plan as a fundamental tool for local sustainable development.
