I propose in this work to give an account of the thought of the French jurist Jean Bodin and his doctrinal elaboration on the notion of sovereignty, key to understanding his Six Books of the Republic, a 16th-century classic that had an enormous influence on philosophical thinking -political later. The central hypothesis that I propose in this study is that the category “sovereignty” is in Bodin a legal concept and not just a political concept or principle. Consequently, I maintain that his ontological vision starts from a legal perspective, from which the author affirms the constitutive character (I mean, previous and formal) of the sovereign power with respect to society and consequently its ontological priority.
