This article proposes to analyze what is the role that copyright has in the field of fashion, investigating its characteristics, development and scope, in order to understand not only the reason by virtue of which its application is usually resisted by some sectors that prefer to resort to other types of intellectual rights to protect the fruit of the intellect associated with this industry but also to try to demonstrate the benefits of its exercise mainly in favor of authors and owners. First of all, the essential elements that make up the copyright system will be briefly analyzed, pointing out conceptual and practical aspects. Second, the link between fashion designs and author elements will be addressed. Finally, by raising the strengths and weaknesses of the discipline, the viability of Copyright in this type of industry will be addressed.
