The present paper has the purpose to make reference to the new paradigm of human rights, the role of so-called State law, in response to one of the most discussed issues concerning the problem of its universality. In concordance with this, manifested in the judgment of the CIDDHH, its recognition and protection. Particularly, the configuration of new crimes against human rights, called femicide or gender-based violence. The present analyzes regulatory, sociological and dikelogical perspectives in response to the teachings of Werner Goldschmidt.
