This article intends to carry out a detailed study of the problem of responsibility in Althusser, who in 1980 murders his wife under what was assessed by expert psychiatric opinions as a State of Dementia. The implementation of article 64th of the French Criminal Code running that time, which determines the non-responsibility of the individual who carries out a criminal act under an insanity state, allows Althusser be benefited with the not to place legal figure, by what was never called to publicly respond for the murder committed. The present work proposes an analysis of this text in terms of what is known as subjective responsibility, in order to discern whether this lecture can be effectively applied or not. For this purpose, the concepts of subject, determination and overdetermination in psychoanalysis will be examined.
