In Rome, captivity automatically leads to the loss of freedom as well as all the prerogatives which are connected with it. The war prisoner’s condition legitimizes all the forms of treatment, because the captive is considered as a part of the booty. Consequently he becomes the exclusive and indisputable property of the enemy. Generally the ancient authors don’t question the discretionary power of the victor on the vanquished because the prisoner of war is the slave of the enemy.
