In Mexico, federal decree 4715 of June 25, 1856 established the confiscation of rural and urban estates held by civil and ecclesiastical corporations. Article 25 of said decree abolished the legal status of indigenous communities to acquire or manage real estate on their own; that is, the right of these communities to have collective property was eliminated. However, in the State of Mexico, the towns retained, under certain legal provisions, their legal personality to acquire and manage real estate. In this sense, the objective of this article is to analyze the personality and legal representation of indigenous peoples in the State of Mexico, from 1856 to 1882. It is interesting to highlight the strategies implemented by the peoples to preserve their legal personality and defend their rights in the courts.
